These Terms of Use (the “Terms”) set out the conditions for using kogoo (the “App”). Anyone who uses the App (a “User”) must agree to these Terms and the Privacy Policy before using it.
Article 1 (Accounts)
- Users can create an account with an email address, Apple or Google. Guest mode lets you try some features without an account (records are not saved to an account).
- Users are responsible for managing their own accounts.
- Users can delete their account and leave at any time from “Delete account” on My Page.
Article 2 (Safety while riding)
- Do not stare at the screen while riding. Stop in a safe place before operating the App.
- Follow the Road Traffic Act and other laws, and the rules of the road.
- Segment time attacks are not races on public roads. Do not ignore traffic signals or ride dangerously for a better time.
- Distance, speed, calories and other values shown by the App are estimates calculated from location and other data and may differ from reality. Please check routes and road conditions yourself.
- Users ride at their own judgment and responsibility. Pay attention to your physical condition, the weather and road conditions, and do not overdo it.
- The App’s voice guidance (including encouragement, directions and fueling reminders) is a guide for reference while riding. It does not require you to ride or eat as guided.
Article 3 (Prohibited conduct)
Users must not:
- Violate laws or public order and morals
- Use inappropriate display names (obscene, discriminatory, violent words, etc.)
- Impersonate the Operator or others
- Share on kogoo Photo sexual, violent or discriminatory photos; photos showing other people’s faces, homes, license plates and the like without their consent; photos taken by others; or advertising and promotional photos
- Harass or cause trouble for other Users
- Falsify ride records or manipulate rankings (including segment time attacks)
- Gain unauthorized access to, or interfere with the operation of, the App or its servers
- Engage in any other conduct the Operator considers inappropriate
Article 4 (Reports and the Operator’s response)
- Users can report other Users and kogoo Photo photos, and block other Users. Blocked Users no longer appear in rankings, kogoo Photo or friends screens, and their friend requests no longer reach you.
- Photos shared to kogoo Photo are checked automatically for inappropriate content, and suspicious photos are shown only after the Operator reviews them. Photos reported by multiple Users are hidden until the Operator reviews them.
- Rights to shared photos remain with the User who shared them. Users allow the Operator to use shared photos to the extent necessary to display them on kogoo Photo. You can stop sharing at any time.
- When the Operator confirms reports or conduct violating these Terms, it may change display names, restrict features, or suspend or delete accounts.
Article 5 (Paid plan “kogoo Pro”)
- The App has features available for free and features available with the auto-renewing subscription “kogoo Pro” (“Pro”). The contents, price and period of Pro are shown on the purchase screen.
- Pro is purchased through the App Store’s in-app purchase system. Payment is charged to your Apple ID when you confirm the purchase.
- Pro renews automatically for the same period and price unless cancelled at least 24 hours before the end of the current period. The renewal charge is made within 24 hours before the end of the period.
- If a free trial is offered, you will not be charged if you cancel at least 24 hours before the trial ends. If you purchase during a free trial, the remaining trial is forfeited.
- You can cancel at any time from the iPhone Settings app → your name → “Subscriptions”. After cancelling, you can use Pro until the end of the current period. Deleting your App account does not cancel the subscription.
- For refunds, please apply to Apple using the method Apple provides. Except as required by law, the Operator does not issue refunds.
- If Pro stops working after changing devices or similar, try “Restore Purchases” on the purchase screen or My Page.
- The Operator may change the contents or price of Pro. When raising prices, we will notify you in advance and obtain any required consent in accordance with Apple’s system.
Article 6 (User information)
User information is handled in accordance with the Privacy Policy. Rights to display names, route names and other content registered by Users remain with the Users. The Operator stores and displays them to the extent necessary to provide the App.
Article 7 (Changes, interruption and termination of the service)
- The Operator may change the App or add or remove features without prior notice to Users.
- The Operator may interrupt all or part of the App without prior notice for system maintenance, failures of communication lines or equipment, natural disasters, outages of external services or other unavoidable reasons.

Article 8 (No warranty)
The Operator makes no express or implied warranty regarding the App (including information shown by the App, voice guidance, content created by the AI coach, and route, segment and ranking information), including as to accuracy, completeness, usefulness, safety, fitness for a particular purpose, continuous availability, freedom from security flaws, errors or bugs, or non-infringement of third-party rights.
- Content created by the AI coach is provided as general information and is not professional medical, exercise, nutrition or other advice. If you have concerns about your health or physical condition, consult a doctor or other professional.
- Routes and segments suggested by the App are not guaranteed to be passable or safe. Follow actual road conditions, traffic regulations and signs.
- The Operator does not guarantee that ride records, photos or other data will not be lost or damaged.

- Users use the App and ride at their own judgment and responsibility. The Operator is not liable for any damage suffered by Users in connection with use of the App (including accidents while riding, injuries, property damage, disputes with third parties and loss of data).
- If the contract between the Operator and a User regarding use of the App is a consumer contract under the Consumer Contract Act, the preceding paragraph does not apply. In that case, the Operator is liable for damage caused to the User by the Operator’s non-performance or tort only for damage that directly and ordinarily arises, up to the amount the User paid for kogoo Pro in the month in which the damage occurred.
- The preceding two paragraphs do not apply where damage is caused to a User by the Operator’s intent or gross negligence.
Article 10 (Disputes between Users and with third parties)
- Disputes between a User and other Users or third parties are to be resolved by the User at their own responsibility, and the Operator will not be involved.
- If a User causes damage to the Operator through conduct that violates these Terms, the User shall compensate the Operator for that damage.

- If you use the App after the effective date, you are deemed to have agreed to the changed Terms.
Article 14 (Severability)
